First of all, this is seriously fucked up, and I'd feel so embarrassed/outraged/wanttomoveandchangemynameworthy if I was this guy's wife or kids.

But, my mind doesn't know when to turn off sometimes and just let something go. So my question is...

Was this only illegal because it was near a school? Like if this was out in the boonies and someone walked in on him, would it still have been illegal? Cuz I saw this porno one time where a chick used a chair leg... the most visually distrubing thing I've ever come across (and yet I couldn't look away)... but I'm pretty sure she didn't get arrested.

Like the article said, it's still technically illegal, but it's only a misdemeanor, unless there are likely to be children present.

Did you actually read the article? He was caught, on film mind you, fully nude. Which would have been a misdemeanor, however, given the close proximity to the school, it bumped it to felony charges. 4 counts.

So the simple answer is, No, it wasnt only illegal because it was near a school.

Okay... yes, I read the article. So I guess I'm just slow, or no wait, never have thought about 'why it would be illegal to fuck a table' before. I don't go looking up all the sex laws out there. My basic question was if this happened anywhere else, would it still be illegal? If he's in the middle of the woods, and a neighbor happens to drop by and see him, is it still illegal?

If it's a matter of public nudity, then why aren't backyard sunbathers arrested? If it's considered against the law to be perverse in your sexual toys why are porn stars not arrested?

I realize people saw him, I realize he was near a school. I was simply taking it out of context. Sorry for thinking further than the story or you intended. I tend to do that sometimes, go off in my own little world, get lost in tangents, etc and it gets me in trouble every time!
