You would also have to assume that anyone distributing these pictures in the first place has half a brain and the motivation to do something for herself. Which was plainly not true.

OMG now THAT would be Drama! Maybe she could get a pro bono lawyer? But the previous posters right, she doesn't seem too bright. I mean she dates guys from internet games for one...

I personally think that case was circumstantial.

I don't think this is in the same league with that guy.

Of course, bad - I didn't see the Philipine thing, just got the link from a site and assumed US law.
Quote:
The info regarding the US federal law you linked is also inapplicable. Nobody knows what that means, nobody has ever attempted to enforce it, and it is unenforceable. What that law says is that you can't argue with someone on the Internet without disclosing your RL identity. Every person on this site, and on every other US Internet forum site who has ever called someone else a cumstain or worse, is guilty of violating that "law". It's been previously discussed on this site, the bottom line is, don't worry about it.
US civil law involving violation of privacy may apply in a case where one girl gave one guy nude photos and he posted them on the Internet. But that would depend on the facts and circumstances of each case, and would also vary by state, and would not involve federal law.
Intentional infliction of emotional distress and violation of privacy torts are civil, not criminal - the most anyone could try and do is sue for money damages, or to get the photos taken down. Such a suit would not be successful, as in the case of Katie, where the girl widely distributed her own photos, then they were also posted on various other sites. The cost of such a suit would be huge, would involve multi-state litigation, and would take a very long time to resolve.
Note that trying to keep private fuck films off the Internet didn't work very well for Pamela Anderson and Paris Hilton (although I admit, a celebrity will have less rights regarding violation of privacy than a private individual).
As I've stated, I wouldn't have allowed the pics if I was concerned about law enforcement or other liability in any way. You shouldn't either, and might be better off spending your time pursuing education rather than such retarded and baseless legal theories.
|
Thanks for the info.
However I fail to see the baselessness of the my 'theories' (I also fail to see them as theories but more as questions) as there are cases being made against people for this very thing (two of the links I have made are US cases).
But basically because she distributed them to several people, the case would fall?

The case you linked above involves identity theft. You can't commit identity theft by posting nude photos of someone else, you have to pretend to be that other person. That situation also involved two people from the same state and is based on Iowa state laws.
I'd bet the guy in that situation created a myspace page or whatever pretending to be the girl, posted her nude pics, and also posted her phone numbers and address with a message something like "I want really fat and ugly married men to urinate on me, call me now and let's fuck till the break of dawn". Ya, that could be identity theft and harassment. Most states have harassment laws that require people to stop telephoning you and coming to your house after you tell them to stop.
I seriously doubt the situation in that article is one where the girl took pictures with her finger inserted in her pussy then emailed them to a bunch of different guys, which is what happened in the case on this site. The article doesn't provide details, and whatever it involved, does not appear to be similar to the situation on this site.
Like I said, I'm not worried about this in any way, and Gaige and the other guys involved shouldn't be worried either.
