It was certainly negligence.
But, EVERYONE should be held responsible/accountable for their actions.
If John had been just walking down the street, unaware of what was going on, it would put a very diffrent light on the subject.

Point: They both fucked up.

Even if John wore a seatbelt he might be in the same condition he is now. The damage was on the passenger side, so assuming the belt would have left him unscathed is a irresponsible suggestion. I've seen lives saved by people not buckling up.

Second, shifting the blame from the drunk guy who chose to drag race is dumb. John cannot be responsible for knowing the BAC of his friend or the stupidity he would exhibit while driving home.

So Niber, we are in a car together and we are sober, driving responsibly, I am driving wearing my seatbelt and you are not. Someone hits us head on and you get hurt or die. Is that MY fault?
Or I swreve to miss a child running into the road and you get hurt, that is my fault?

Had John been wearing a seatbelt he MAY not have gotten hurt just like Nick. The drivers side was more fucked up than the passengers. Look at the pictures. Nick's side hit the damn tree.

If someone hits you head on, then no. But if you hit a tree. Yes.


EDIT:
You're absolutely responsible for your actions as the driver of an automobile and the implication to the passenger(s).

Where I live, yes, it would be your fault. The law requires that the driver ensure his passengers are wearing seatbelts. If the police find that he hasn't done so he will receive a ticket for each person not buckled, not the passengers, and the fine isn't small.

I personally won't let ANYONE in my car without one. My kids will be in carseats until they are 8 if not longer. But... the point is... John chose to not wear it, chose to get in the car with Nick drunk and I agree with Illy, BOTH of them fucked up. I personally think that whole family is a bunch of monkeys.

Assuming John knew Nick was drunk is a pretty big assumption. Nick was drinking beer, not taking shots.

They both fucked up big time. But I do think Nick is responsible for his passengers. You don't allow someone in your car like that. You know how much you've had. You shouldn't be a fucking tard about it.

Maybe not legally, but some degree of common sense should have put up a warning flag.

This seems to me like an unreasonable legal burden.
