yeah, don't get me wrong, i think they should crucify drunk drivers who cause bodily injury/death to others, be it passanger, other driver or pedestrian.
I've lost two friends to drunk drivers so far in my life, one was riding his bicycle at 8am on a Saturday.
But if you get in a car with someone you know has been drinking, you've just lost innocent victim status.

That's what makes the whole thing so disturbing. I don't know if you've heard Nick's taped jail conversations but it's disgusting.

It's his son, what exactly do you expect him to do? He's not trying to completely negate it or his son's culpability, he's just trying to help his own flesh. If you're not the victim's family and cop attitude over a private conversation between father and incarcerated son, you don't have enough serious shit in your life to help you have perspective. Illuminator, it's not unreasonable. You as the driver are responsible for all in your vehicle. In short, the law forces you to have a policy of "no belt, no ride" or be willing to pony up the extra costs of dealing with dumb asses who feel too cool to wear a safety belt or whatever excuse short of pregnancy. If you don't like it, work it out between you and the passenger but the law is focusing on the primary responsible party, the captain of the ship so to say.

When a victim has a resonable way to avoid trouble and doesn't take it, he shouldn't be allowed to completely shirk that responsibility. If you know the driver is about to do something stupid and you get in the car and compound it with your own stupidity, you've pretty much given up all rights to bitch when something goes wrong. Just because you got hurt doesn't absolve you of your own culpability nor does it force me to feign sympathy for you being a dumbass.

Your reading is incorrect. He blew over the legal limit and the drinking did not occur at night, it was during the day on a boating trip with his father.

Cause as far as I know the normal legal limit is .08...

The legal limit is .02... The limit enforced by the DMV is .08. A cop can give you a DUI at .02, if he feels that you were driving in an unsafe or reckless manner, but any BAC over .08 is an automatic citation.

It's a coincidence that I know that >.>
