I guess had Congress been more willing to protect the constitutional rights of minorities the courts wouldn't have been forced into that role.

Case law is purely a matter of how courts decide to conduct themselves and has minimal relevance to the other two branches who can go about their business regardless if they use the powers the Constitution gives them.

But (a lot of) Americans are descended from Europeans, and the Crusaders were Europeans.
