Nobody is "banned", these are 3 day suspensions for people who refuse to follow the rules.
These Site Guidelines apply:
New supplemental posting Guidelines for Admins and users
In applicable part, these Guidelines state that when a user starts a thread about a specific topic, but then that thread is purposefully derailed by others, the person who started the thread has the right to demand that it go back on topic, and also has the right to ask a mod or admin to require the post to go back on topic. Once that assistance is requested by the OP, a mod or admin will respect that request and will delete any further off topic posts made in the thread.
Now, their are only 3 "flame free" sections on this site: Tradeskills, Guild Recruiting, and Fan Site News and Announcements.
So a recruiting thread in the Unrest section can be flamed in an on-topic manner just the same as any other thread started in that section. But, once the OP calls for his or her post to go back on topic, ONLY on-topic replies are thereafter permitted in that thread, but it doesn't matter whether those subsequent on-topic replies are constructive or outright flames, as long as they are on topic.
It seems to me that Talonis requested that thread to go back on topic, but that the people who received 3 day suspensions refused to comply and continued making off-topic posts. I will not overturn the suspensions for that reason. Please let me know if I'm missing something or misunderstand the situation.
FYI - these guidelines were enacted on this site after great debate for the purpose of preventing "NGD" style spamming - so that if ANYONE wanted to have an on-topic discussion on this site, they would be able to do so without getting their thread spammed into oblivion by off-topic replies. These guidelines respect the rights of all users to hold conversations on this site and prevent the site from being turned into a bottomless cesspool where a small handful of users can ruin the experience here for everyone else.
