There was already an example of this... MMIS Mayong and Contested Mayong. They are literally the same encounter apart from the increased adds on the Contested version.
The people/guilds complaining about not getting chances of Contested such as Contested Mayong, could probably not kill the easier Instanced version until several nerfs had been put in place.
So, while it sounds like a good idea, it isn't.

If this did happen then there would just be more guilds out there on the other servers that would step up and start talking shit about being that good. Some guilds have been on the same servers since launch, players in the guilds move around due to what classes are needed and who has openings.
Strike and Chaotic legion are the only top guilds that I can remember that purposely moved to another server to get away from competition, STD did as well but they got owned and broke up after they moved to unrest and still could not kill shit. There are servers were contested are being killed by more than one guild and the competition is fierce enough to be raiding at all hours depending on spawn times.
Contesteds are the best loot in the game and you have to have the commitment and availability of players in order to kill them which is why the rewards are so great.

!?!?! Be carefull dude- 20 people just argued for 50 pages that it only takes 3 15 minute play sessions a week, and that the time requirement myth was just that, a myth.
