Eh, do a google search, there's plenty of history laying around (some accurate, some not so much... and plenty of fanbois on both sides offering their heavily biased opinion).
The bottom line is that the original Warcraft IP was heavily "borrowed" from the GW Warhammer universe. There was an attempt by Blizzard to get a licensing deal, which never went through, and apparently they tweaked it just enough to avoid litigation. People have been saying for years that GW should have sued though. =)
WoW is a very different game from the original Warcraft, so at this point the argument is kind of moot. There's plenty of "sharing" of ideas across MMO's these days anyway (moreso mechanics than actual IP though).
You could argue that Tolkien's estate probably holds the IP rights, if not legally at least in spirit, to most of this shit anyway...
