Pinski is right actually.
The term "uncontested" just means that it doesn't take into account skill checks, i.e. your skill to avoid vs. the mob's skills to hit. However, it still takes into consideration base levels of encounters.
The reason that uncontested avoidance is king as far as avoidance in general goes is because of SoE's laziness. See, instead of building ultra-solid game mechanics, they just compensated for the godly avoidance they gave tanks in the KoS days by giving mobs higher offensive skills.
If you can remember this far back, you may remember that week or two where end-game raid tanks were tanking in cloth robes shortly after the "avoidance fix" about 2 years ago because they simply couldn't be hit. Instead of claiming ignorance when gamers cried FOWL, they "fixed" it by giving all tanks a base avoidance percentage regardless of gear and adjusting mob's to-hit bonuses to level the playing field.
Fast forward 2 years and the same problems persist. Nasty spike damage due to massive mob hits and ultra high offensive skills were put in to compensate for far superior tank avoidance. Ironically, avoidance in general is probably just too high for every tank but necessary to defeat mobs with such exceptional offensive prowess. The next obvious (and lazy) fix was to add uncontested avoidance to counterbalance all this yet again when the level cap increased. But sadly, the con level of a mob still plays a roll in adjusting how uncontested avoidance works: at this point though it's nothing more than a balancing tool.
It's the unfortunate truth, but truth none the less.
Less overall avoidance for everyone and reduced mob spike damage would make for better and more tactical combat imo.
