Where has Ajjantis been hiding for goodness sakes. How does one post 1,630 posts before such self pawnage. As you can see I have never posted much and just been an avid fan, but holy hell this has been some great stuff. Tuor move on over there's a new clown shoe in town.

I'd really like to know what hack of a lawyer would even consider pursuing this. How much are you gonna invest in this guy before you come to the conclusion that you wasted a lot of time and money chasing some guy who posted a pic of you on the internet?

correct me if im wrong, but unless this person accessed your computer, phone or camera, that pic is free internet game... where did it come from again?

Things are pretty simple here. He has pictures of me (no matter where they are from, it just doesnt matter - just accept it) and uploaded them here without my permission. That is against the german law, i dont know how things are handled in the usa. But the german law is pretty clear here:

§ 22 KUG bestimmt:
„Bildnisse dürfen nur mit Einwilligung des Abgebildeten verbreitet oder öffentlich zur Schau gestellt werden

Basically: He can not spread these pictures without my permission. Got it sofar?

Ive done this also. Ive asked the pictures to be removed - several times now.

Since he refuses to do so, he even re-posted them after a mod removed them we can go to this part. This is good because my lawyer said i have to give him the chance to remove them. Now that he re-posted them i can go one step further.

So i went to my lawyer, i explained him the situation. He said things are difficult because of the forum being in america. He said he can do something, but i'll cost a good amount of money. But he also said we can successfully charge the one who uploaded them, in this case Shade because he is german. And he said that chances are VERY good that we can get him. He told me my next step will be filing a charge against him. Ive done that Friday. Im waiting for the prosecutor now.

You know, filing a charge and eventually bringing this to the court DOES NOT COST ME A SINGLE CENT. You can laugh all day about this, i could care less. All i know is that shade eventually will have to pay, and that is all i want. If not, i can say i tried. But as far as ive been informed things are going pretty well. So lets wait....

Incorrect. You have had no financial damage due to the posting of the picture, nor did Shade gain any money. Thus, you are not entitled to Schadensersatz. In Germany there are no ridiculous laws where you can sue somebody for 500 billions because he poured a hot coffee over you, or called you a bad word, contrary to the USA.

Tbh, if this whole fuzz is due to the 2 pictures Shade posted, you're a sorry loser with too much time on his pathetic hands.

Why, nobody is gonna take this on a contingency fee basis (which isn't allowed in Germany anyway) so he has got to pay the lawyer for this.

Apart from that Ajjantis is likely gonna win the case for an injunction and recover the lawyer's and court fees from Shade (depending on where Shade took the pics from and whether he just linked them from the original source or uploaded them somewhere else - yes it does matter Ajjantis). However, since Ajjantis doesn't really stand a chance to get damages awarded Shade is gonna win that part and Ajjantis will have to pay the costs for that. Depending on how greedy Ajjantis is when stating his claim (costs are calculated based on the amount you claim) Shade is probably gonna come out ahead on costs.

Which can only mean that Ajjantis is piss poor and filed a request with the court that the taxpayer pays his court and lawyer's fees because he can't afford them.

The laws are mostly the same, but in Germany it's a professional judge deciding, not a jury, and that's the reason.
