Which is better?
I'm inclined to use the older one, since the recast is over a minute less and I play on Nagafen, but I just wanted to make sure there is no difference in the resist rates.
Or does the older spell actually have a lower resist rate, since it is M2?

Honeslty id have to parse it out (im lazy or i would have already), i would think against a level 80 opponent the higher tier spell would be more efficient, though im not sure exactly, ill fuck around with it and get back to you.
Edit, on PvP im almost positive the level would make a difference with resist rates, etc.

You'd be playing the wrong game if you think level matters on your abilities for your hit-rate.
In a PvE situation for the most DPS, you should use Pestilent Touch. In a PvP situation, since it's all about spike DPS, use Death Touch. Harm Touch has no resist chance, it is a guaranteed hit, so quality of spell means dick for resist rates. PvPing is all about spike dps, get the person down to 30%, hit DT, boom dead, use PT, they could still be at 2%, and manage to survive and kill you.

Not sure if you were referring to PvE or PvP, but I've had Pestilent Touch get resisted in duels quite often. Sometimes multiple times in a row. I haven't, however, ever experienced a resist on it in PvE.

Thanks, but it does get resisted a ton in PVP.

Aye as far as a direct hit on an NPC it usually hits, though i have come across the 1 or 2 times in a great while (PVE) where it has resisted, and i would imagine if somone had their disease resist up (If resists matter in PVP (Never got into high level PVP)) that they could resist it a bit, so i would think level would come into effect there.

At that damage difference, yes. The M2 wins in PvP for the resist chance and the fact that 19 damage < 6% less resists.
