Get it to spawn once.. I dont think it can really be considered an exploit.. since it isn't -free- loot.. you have to kill a major mob..would I want to regularly do that? well it starts moving into that grey area...
Get CL2 to spawn over and over to farm it? Yeah I would consider that an exploit..
One question though, do all the zones that avatars spawn in have the capacity to instance? if no, then I would definitely say that doing the instance effect to get more of them is definitely unintended.. which demonstrates that someone at SOE isn't thinking as far as "if instance number is greater than 1, don't spawn me"...
I keep one thing in mind when I am trying to decide if something is an exploit of game mechanics.. and that is the risk or effort vs reward... and kickstarting another instance to nail a tough mob once.. yeah not really a problem.. it isnt an easy mob... continually kickstarting that second instance over and over? now you are moving into that exploit territory simply because you are getting what amounts to the same mob over and over and over again... increasing reward without dramatically increasing effort to get the reward..
And since I cant see how fixing this type of spawning would be all that hard (since it is a very simply programming concept).. I can't see SOE taking it all too seriously..
